General terms and conditions
The General Terms and Conditions apply to all contracted services provided by the computer programming business Tinako, Kralja Tomislava 43, 31223 Brođanci, (hereinafter: Tinako) and as an attachment are an integral part of the contract. If different business conditions have been agreed by a special contract, those conditions from the contract shall apply. These GENERAL TERMS AND CONDITIONS, as amended, are valid for advertising in the Republic of Croatia from 31.05. 2019
ACCEPTANCE OF ORDERS
1. Orders are accepted exclusively in writing (E-mail), indicating the name of the service or service, duration, all requirements that the customer wants to make, delivery deadlines, etc. After receiving the order Tinako sends customers an offer for payment. In case of acceptance of the offer - the Client will inform Tinako in writing and make the payment according to the offer.
2. After accepting the bid, the client is obliged to make the payment within the agreed time. The client has the right to cancel the order at any time, ie until the moment of payment according to the offer.
TERMS, METHOD AND DEADLINE OF PAYMENT
1. The Contracting Parties agree that the calculation of the total price of services by Tinak, as well as the obligation to pay on the part of the Client to Tinak, shall be considered acceptance of each new offer by the Client in writing.
2. The Client undertakes to pay for the services of Tinako in advance, according to the issued offer, ie before the execution of services, or by invoice if Tinako has approved in advance the deferral of payment for services to the Client.
3. Tinako is obliged to submit an offer or invoice to the Client during or after the delivery of the service during or after delivery (by delivery of the invoice by e-mail or post).
4. The Client may pay for the Web Design service in full or in two parts, unless otherwise agreed. In the form of an advance, the Client undertakes to pay at least 50% of the total price of the service as proof of order, unless otherwise approved by Tinako. The rest, in the case of payment in two parts or more, the Client undertakes to pay no later than immediately before the handover or execution of the service. Payment of 50% of the agreed amount is considered a guarantee that the client actually orders the service and that Tinako can start with the start of the service. The client is not entitled to a refund of the advance in case of cancellation.
5. Annual website maintenance service, if the Client contracts; The Client undertakes to pay in equal monthly annuities, no later than the 10th of the month for the current month at the price agreed or once in advance in full before the start of the service. The Website Maintenance Service is contracted for a period of one year, and in the event that the Client wishes to cancel the service at any time, it will notify Tinako at least 30 days in advance. The items of this service are listed in the Specification.
6. Services of creating advertising campaigns, advertisements and marketing on the Internet, the Client will pay in advance in full according to the offer for the current month, at least 3 days before the start of advertising at a price agreed in advance for a certain period or current month. The service of creating advertising campaigns and advertisements is contracted in advance for a predetermined period of time, and in case the Client wishes to cancel the service performed by the Consultant at any time, he will notify Tinako at least 10 days in advance.
7. Strategy and plan development services The Client will pay in full or in a maximum of two parts. In the form of an advance, the Client undertakes to pay a minimum of 50% of the total price of the service as proof of order. The Client undertakes to pay the rest immediately before the handover or execution of the service. Payment of 50% of the agreed amount is considered a guarantee that the client actually orders the service and that Tinako can start with the start of the service. The client is not entitled to a refund of the advance in case of cancellation.
8. Website optimization and advertising campaign services to increase results, the Client undertakes to pay in advance in full. The optimization service is contracted in advance for a predetermined period of time, and in the event that the Client wishes to cancel the service at any time, it will notify the Consultant at least 30 days in advance. For optimization services, the consultant cannot guarantee the Client any visible results or successful execution of the service, and in case of failure, the Client has no right to appeal and refund.
9. Visual and graphic design and printing and printing services The Client undertakes to pay in advance in full. The Client has no right to appeal and refund for the performed service.
10. The Client is obliged to make the payment within 7 (seven) calendar days from the date of receipt of the bid / invoice, except when a different due date is stated on the bid / invoice, in which case the Client is obliged to pay the invoice within the bid. / account.
CONDITIONS, DEADLINES AND METHODS OF DELIVERY
1. Products and services will be prepared and delivered in accordance with the agreed quality, design and specifications in accordance with the agreement between the Client and Tinak specified in the Specification, Order or Offer.
2. Tinako undertakes to deliver the services within the deadlines agreed between the Consultant and the Client when accepting the order. In case nothing special is agreed, the standard delivery time is determined by Tinako.
3. The agreed delivery date starts from the day of the recorded payment by Tinak, which does not include Saturdays and Sundays and public and religious holidays.
ORDER CANCELLATION
1. The Client may cancel a written order, confirmed in writing, without legal consequences no later than 5 working days (five working days) after payment and acceptance.
2. Otherwise, the Client pays the following fee for the price of the ordered service:
2.1. In case of cancellation from 5 to 14 days after acceptance of the offer and payment of funds - 50%
2.2. In case of cancellation from 14 to 30 days after acceptance of the offer and payment of funds - 70%
2.3. In case of cancellation after 30 days after acceptance of the offer and payment of funds - 100%
3. Cancellation of the Website Development Service: Payment of 50% of the agreed amount is considered a guarantee that the client actually orders the service. In case of cancellation up to 5 working days after acceptance of the offer and payment of funds - the Client is entitled to a refund of 50% of the advance amount (25% of the total contracted amount). The client is not entitled to a refund of the advance in case of cancellation after 5 working days. In case the client has paid in advance for the service in full - 50% of the amount plus a part of the advance will be refunded to the client - 50% of the advance within 5 working days and 0% of the advance after 5 working days from the order.
4. The rights referred to in item 2 shall apply to the cancellation of the website maintenance service of the Client.
5. The Client is not entitled to a refund for the cancellation of the marketing campaign and advertising service.
6. The Client is not entitled to a refund of the website optimization service.
7. Cancellation of the strategy and plan development service: Payment of 50% of the agreed amount is considered a guarantee that the client actually orders the service. In case of cancellation up to 5 working days after acceptance of the offer and payment of funds - the Client is entitled to a refund of 50% of the advance amount (25% of the total contracted amount). The client is not entitled to a refund of the advance in case of cancellation after 5 working days. In case the client has paid in advance for the service in full - 50% of the amount plus a part of the advance will be refunded to the client - 50% of the advance within 5 working days and 0% of the advance after 5 working days from the order.
8. The Client is entitled to a refund of up to 5 working days from the order for the cancellation of the visual and graphic design service. After the expiration of 5 working days, the Client is not entitled to a refund.
9. In case of cancellation and approval of the refund, Tinako will cancel and refund the Client within 30 days from the notification of the approval of the refund.
COMPLAINTS
1. The Client is obliged to inspect the delivered services immediately upon receipt or in agreement with the consultant in the development phase in the usual way or give them for inspection to an independent professional (at his own expense). In the case of printed materials, the client is obliged to inspect the materials and approve the printing before the printing order.
2. The Client undertakes to notify Tinaka without delay of any visible defects or possible omissions within 5 working days after the performance of the service.
3. Complaints about possible defects in the delivered services must be submitted to the Consultant without delay before, during or after delivery, in writing.
4. Written complaints from this article of the Agreement must be submitted to the e-mail of the Consultant and should contain information on:
4.1. The date of receipt of the defect and the date of filing the complaint;
4.2. The defect due to which the complaint is submitted;
4.3. The defect must be specifically and as clearly described as possible so that the Consultant can assess the defect and act adequately, ie eliminate the defect and the deadline, or find an alternative solution;
FINAL PROVISIONS
1. These GENERAL TERMS AND CONDITIONS are mandatory. All possible misunderstandings of the contracting parties are obliged to resolve amicably, and if this is not possible, the court in Osijek has jurisdiction.
2. These GENERAL TERMS AND CONDITIONS apply for an indefinite period of time or until they are supplemented, and enter into force on the day of signing the contract or the day of accepting the order.
